New Mexico has shifted focus from cannabis expansion to enforcement, with House Bill 10 establishing a new Cannabis Enforcement Bureau under the Regulation and Licensing Department.
Backed by $1.6 million, the bureau will include up to 10 certified law enforcement officers empowered to shut down non-compliant businesses, seize illicit products, and file criminal charges.
The move comes amid concerns over excessive dispensary density—like in Sunland Park, where over 30 dispensaries serve fewer than 20,000 residents—and signs of illicit activity and underage use. Albuquerque leads in cannabis sales with $350 million, followed by Sunland Park with $127 million.
The new bureau can now conduct surprise inspections, embargo untested products, and issue fines up to $10,000 per violation.
Lawmakers are expected to consider zoning changes and licensing caps in the upcoming legislative session as the state reevaluates its approach to cannabis regulation.
