What License Types Exist in New Mexico?

New Mexico issues a personal cannabis production license, 10 licenses for recreational cannabis businesses, and four medical cannabis licenses. New Mexico's adult-use cannabis license types are issued by the Cannabis Control Division of the New Mexico Regulation and Licensing Department while the medical cannabis licenses, including the personal cannabis production license, are issued by the Medical Cannabis Program of the New Mexico Department of Health.

Cannabis business licenses issued in New Mexico include:

Personal Production License

This license is issued to a qualified medical marijuana patient and authorizes the registered patient to grow medical cannabis in an approved location identified on the license. A personal production licensee in New Mexico may cultivate up to four mature female cannabis plants and a total of 12 seedlings and male cannabis plants. The licensee may possess no more than an adequate supply of usable cannabis, seeds, or plants from licensed non-profit cannabis producers.

Adult-Use Cannabis Producer License

This license permits the licensee to cultivate cannabis plants, possess unprocessed cannabis products tested by a testing laboratory, and transport unprocessed cannabis products to other licensed cannabis premises. The New Mexico adult-use producer license also permits the licensee to sell cannabis products wholesale.

Adult-Use Cannabis Manufacturer License

This license authorizes the licensee to process uncultivated cannabis into oils, edibles, and other cannabis products. Also, the licensee can legally package cannabis products; possess cannabis products tested by a testing laboratory; and acquire, sell, or transport wholesale cannabis products to any other licensed cannabis establishment.

Adult-Use Cannabis Retailer License

The adult-use retailer license authorizes the licensee to sell cannabis products to qualified patients and primary caregivers. Such licensees are also allowed to sell cannabis products to reciprocal participants or directly to cannabis consumers.

Vertically Integrated Cannabis Establishment License

A vertically integrated cannabis establishment license permits the licensee to act as a cannabis courier, cannabis manufacturer, cannabis producer, and cannabis retailer.

Cannabis Producer Microbusiness License

The New Mexico cannabis producer microbusiness license permits the licensee to act as a cannabis producer. However, the licensee is restricted to a single licensed premises and possession of no more than 200 total mature cannabis plants at a time.

Integrated Cannabis Microbusiness License

This license authorizes the licensee to conduct one or more of the following cannabis operations:

• Cannabis production at a single licensed premises if the licensee does not possess above 200 total mature cannabis plants at any time
• Cannabis product manufacturing at a single licensed premises
• Sales and transportation of the cannabis products manufactured or produced by the licensee
• Operating only one cannabis retail establishment
• Couriering of cannabis products to qualified medical cannabis patients, primary caregivers, reciprocal participants, or directly to consumers

Adult-Use Cannabis Courier License

This license authorizes the licensee to transport cannabis products to qualified medical cannabis patients, primary caregivers, reciprocal participants, or directly to consumers.

Cannabis Consumption Area License

This license permits the licensee to operate an area or site where cannabis products may be consumed.

Cannabis Research Laboratory License

This license authorizes a research laboratory to legally produce and possess cannabis products and the cannabis plant for the purpose of studying the cultivation, characteristics, or uses of the cannabis plant.

Cannabis Testing Laboratory License

This license allows a laboratory to sample, collect, and test cannabis products. The license also permits the licensee to transport cannabis products for the purpose of testing.

Non-Profit Producer License

This license is for vertically integrated marijuana businesses and permits a licensee to grow medical cannabis plants, extract, process, and produce medical cannabis products. Under this license, the licensee may also dispense cannabis products to registered patients.

Medical Cannabis Manufacturer License

One of the licenses issued under the state's medical cannabis program, the New Mexico medical cannabis manufacturer license permits the licensee to:

• Manufacture cannabis products
• Package, courier, or transport cannabis products
• Have cannabis products tested by a licensed cannabis testing facility
• Obtain, purchase, sell, and transport cannabis products to other cannabis establishments
• Prepare cannabis products for personal production license holders

Medical Cannabis Courier License

The New Mexico medical cannabis courier license authorizes the licensee to deliver cannabis from New Mexico non-profit producer licensees to qualified medical cannabis patients.

Medical Cannabis Testing License

This license permits the licensee to test cannabis from registered medical cannabis businesses in the state to ensure that the medical cannabis sold to qualified patients meets testing regulations.
